I have a question about what my fiance's ex wife can do to hold up the divorce proceedings. My fiance had filed for divorce a few years ago on his own and the paperwork was filed out incomplete so the motion never went through. He just filed again in the beginning of this month. Before his ex received the papers she was going on and on about how she would just sign and send them off since there is no property or assets. This was a week before she took him to court to get a change in her child support order. The judge dimissed the case because the old child support order was still in effect, she has to wait one more year. Now she won't sign the papers. She said that she's entitled to alimony. They were married for a little over 7 years when she cheated on him and he caught her (he left everything; the house, the car, the money). They've been separated since 1998. She didn't work while they were married but got a full time job right after he left. Now she decided she wants to go back to get her masters degree and work part time. She thinks that she can get alimony because while they were married she didn't work. Can she get alimony? How long can she hold up the divorce proceedings with her games? My fiance is far from rich and there are no marital assets remaining so there really isn't anything to give her. He pays his child support and then some.
