my uncle married a woman they divorced. he became very ill and unknown to anyone remarried this woman while in the hospital. in the divorce it spells out how the community property is to be divided. the annulment which states that the marriage was not consumated and also states that property was acquired. according to the final annulment decree everyones assets are to remain with individual in pocession of that asset, problem is the marriage lasted 1 day according to paperwork we are looking at. He is suffering from stroke, heart, dementia, and many other ailments and at the present time i am looking out for his well being. prognosis is poor.
I am wondering whether an annulment can cancel out the dictates of the judge who issued the divorce decree prior to this annulment. there is property a home and other assets that i believe the wife is after. the divorce decree says that all property is to be divided equally. I just located my uncle about 3 months ago, because of his illness he was unable to notify us that he was in a dump of a nursing home. i have since moved him. he has a daughter that i am trying to locate. He was not properly served, and was not even aware that she had the annulment. it was only when i had him moved that i discovered his briefcase. a few days later the nursing home forwarded the annulment papers, postmarked march 22, 2001. marriage took place july 3 2000, and ended july 3, 2000.
