What is the name of your state? North Carolina
My husband's ex wife gave up her 1/2 of the home in agreement that he would write a will stating he would leave the house to their 2 children upon his death. We have been married for 4 years now, and have a daughter together. Does anyone have advice for us? Can we change the will and be ok or will the divorce papers void the will in regards to the home? What about if both of our names are on the deed?

Strange clause, considering that most people have moved on to a different house, or perhaps are living in an assisted living facility by the time they die! Not to mention that minors cannot CONVEY real estate, so if they DID inherit IN THEIR NAMES while minors, the home cannot be sold until they reach majority.

Did an attorney actually come up with this nearsighted agreement?

Look, isn't it EASIER for Wife Two to just BUY a supplimental life policy against her husband that will pay her enough money to MORE than cover the entire cost of a different home and then some? That cannot be challenged, especially if wife two is OWNeR of the policy!
