What is the name of your state (only U.S. law)? Texas. Hi I just about almost a year ago married my daughter's father. But when we were not together he ended up going. To prison, and I went thru a custody battle with his parents, which I ended getting custody, but now we are married and now getting a divorce, does that order change. FYI he is still In prison.

Yep. Because as part of the divorce you have to do custody. If he is in prison, you will get custody. But now it is between you and him and not you, him and his parents.
