Divorce and Legal Custody

I'm planning to leave my husband in the very near future.

My main concern is that we have legal custody of two children from his side of the family. A ten year old that we've had for six years and a 13 month old that we've had for ten months. Both are from different mothers (husbands cousins). I don't really see a problem w/ the ten year old but the baby's mom is constantly threatening to take us back to court and get him back (she was in prison and gave us legal custody while she was there). She was in prison for selling drugs to a police officer.

My husband won't fight me for the kids.

What are the chances that the judge will look favorable on the mother if we separate and give the baby back to her? What are the consequences for this divorce decision as far as the children go and them being on his side of the family. There is no way to salvage the marriage.
