My step son has been divorced for 3 - 4 years. His ex-wife was awarded rights to his house but the mortgage was in his name only. Just recently the mortgage company informed him that they were going to foreclose because his ex-wife was consistently late with the payment. His ex-wife over the last 3 - 4 years has been negociating with he mortgage compay to allow her to defer payments, make partial payments, etc.. Again her name is not on the mortgage. The mortgage company had never contacted my step son regarding any of the negociations between his ex-wife over the 3 years until just recently when he was infored that they were proceeding with foreclosure.

Can the mortgage company negociate with his ex-wife even though her name is not on the mortgage?

Can my step son stop the foreclosure from proceeding until he gets all of the past history between the mortgage company and his ex-wife?

Any other course of action you can suggest? My step son does not want the house. He wants time to leagally force his ex-wife into selling the property which was quick claimed over to her in the divorce. Since my step son was never contacted by the mortgage company regarding his ex-wifes poor payment history, was never contacted regarding the negociations for payment deferals, ect... does he have grounds againts the mortgage company? The mortgage and property is in Oklahoma.

Any assistance is appriciated.

He amy have a claim against the mortgage company for failure to communicate but that is nothing compared to nonpayment of the mortage and foreclosure.

He needs to hire an attorney now because his credit is going down the toilet.
