My ex and I were divorced in Indiana in Dec. 1999. The settlement agreement states that the Wife shall assume and pay that portion of the marital debt which is not paid off by the proceeds from the sale of the property and shall save and hold the Husband harmless from the payment of any portion there-of. Our student loans were considered part of the marital debt. She in turn filed Chapt.7 bankruptcy, but did not get the student loans discharged. My question; Is she still responsible for the student loan debts? Should I now begin paying them and take her to Small Claims court for the unpaid portion? Thanks for any reply, zyxwvuts
