State: Live in SC was married in GA.

I am married and seperated for 7 months as of today. i want to know what i need to do to get solid grounds to get an annulment from my wife on the basis that she is gay. do i need letters from previous girlfriends, or pictures or what? any help would be grateful. thanks.

My response:

"Gayness" (if I can coin that term) or Bisexuality are not grounds for divorce or annulment.

However, the issue comes down to when she knew, and when you knew, of her predilections. This is because there may have been "fraud" perpetrated upon you at the moment of marriage.

If you knew, prior to marriage, of her sexuality, then there is no fraud, and you'll need a standard divorce.

If there are no children in this marriage, you may as well opt for a "No-Fault" divorce, and be done with it. Who needs an expensive fight ?

I don't think SC allows no fault divorce. They do have an adultery category in their list of grounds for divorce. The definiton of adultery is a married man (or woman) having sex with "someone" other than the woman (or man) to whom they are married. Does adultery (in law) have to be committed with a person of the opposite sex???
