My wife and I have been separated for 3 years. We got married in Maryland and lived together there for 3 years. I am now in Malaysia and she in Texas. We want to get divorced (no-contest, no-alimony, no-kids) by mail and get a decree from the USA. Is this possible? If so, please advice the cheapest and quickest way. Which divorce law would be applicable, Maryland or Texas?

My response:

Maryland is definately out of the picture. Neither of you live there any longer. So, since you want a U.S.A. decree, your only choice is Texas. Have your wife file in Texas for an Uncontested Dissolution (Divorce). Then, when the papers are ready, she'll mail them to you for signature. Make sure she faxes them to you first. The fax "draft" versions are necessary so that you can review the papers first, to make sure everything is in order and that this is what you want to do. Then, when the originals get to you, a quick perusal and signature is all that will be required. Of course, make copies for yourself, and mail the originals back to her for filing with the court.

Good luck to you.

Dear IAAL,

Thank you very much for your response. One last question. Once my wife files the papers in court, roughly how long will it take to get the decree?

Best regards,

Sam Cooper

My response:

Assuming she files tomorrow, and keeping the mail delivery in mind between here and there, figure a turnaround time of about 3 months or so. And, that's assuming the judge doesn't take his damn time about signing the Decree. Some judges are slower than others.

That's my best guess and prediction.

Oh, I forgot to mention . . . do you trust your wife with the money for filing fees, etc. ? If you do, send her the money directly. If not, send the money directly to the courthouse Clerk. Just let your wife tell you how much the fees are, the address of the court clerk, and act accordingly.
