I'm from Indiana. We were made legal guardians of two of my grandchildren 3 years ago. My daughter is no longer in the picture. They are strictly our responsibility. Unfortunately my husband and I have not been seeing eye to eye on this and I feel I can no longer stay with him because I am unwilling to give up the babies. If I leave him would I be eligible for child support for them? Also we own three homes (not fancy just paid for) two of which we have gotten since we were married in '93. Could I possibly have one of these for me and the kids? I really don't know what to do. I just know I need to get out of here. Please help me. Rita

You are entitled to half of the property that accumulated during the marriage, so presumably one of the houses could be designated as yours in the settlement.

If he had adopted the children, you'd definitely have a child support issue.

To be honest, I'm not sure about the strength of your argument if you merely have a guardianship, however. I've never had this question come up.

Maybe one of our other esteemed attorneys can give me a hand on this issue.
