court will be in florida:

me and me husband went to court on feb.22,2001. we settled for 6 months each, co-custody, even though it is not what i wanted! well, at the time, he was in va, and i was in nc. florida retained jurisdiction becouse the child lived in that state 6 months prior to the hearing. i took her to nc only a month before. my husband had left us to go back to va in feb. of 2000. anyways, after court, i decided to move to ga with the child. my husband did not approve. he is now refusing to take his visitation becouse he wants to be able to go back to court and tell the judge that i would not agree to meet him halfway between ga and va for him to see his daughter. this is not true. i have driven all the way, and he refused saying that we would just be teasing our child by only letting her see her father for the weekend. i received a petition to return to court. it was not to modify the agreement, but to re do it by letting the judge decide. my daughter loves liveing with me. i am so scared! i cannot loose my precious baby!

Did you give him a written notice to move by return receipt? If not, you had no legal right to move and take the child.

Regardless, of his refusal, he could have come to GA to pick up child and refuse to return her/him, and there would have been nothing you could do.

Do you have proof that you have driven the entire way, and he refused?

You are going to have to prove to the court that your move was beneficial to the child. BUT also you will have to explain why you took the child without consent, and against a court order.

Think of how the other parent feels... They already have lost their precious baby.

You don't say what age the child is, but if he/she is old enough to decide where the residence should be (without coersion from either parent) Then his/her voice MAY carry some weight.
