If i get a divorce and file bankruptcy how does it affect my husband or ex-husband? I sincerely do not want him to carry the burden of our financial problems (which i have created) because of good his military record.

My response:

You're also not sure which bulletin board to post on.

However, the best way to answer your question, I imagine, is by example. Let's say that during your marriage you and hubby racked up an unsecured "MasterCard" debt to the tune of $5,000.00. Both you and hubby would be responsible, jointly and severally, for the debt. Now, one of you decides that you want out of the marriage. In the divoce decree and order, that debt is divided equally between you, or $2,500.00 each. However, due to unforeseen circumstances, you can't pay your share of that debt, per the court order, and you decide to declare bankruptcy. MasterCard Corporation does not care about, nor are they a party to, the divorce decree and order. All they know, and care about, is that they get back their $5,000.00, with interest. But, alas, they received Notice of your pending bankruptcy, and eventually, your bankruptcy is granted. Guess who they're gonna look to now for the full payment of the debt? Yep, that's right, good 'ol ex-hubby.

Best of luck to you.
