have a quick question
can a divorce decree be over turned?
the reason why i asked this is because in my husband and his ex's decree states that no child support is to be given as long as child continues to live in the lifestyle that he is accustomed to.
father had custody of son since the son was two years old
the father employment status changed from working during the daytime 8-4 to 3-12
and mother was able to change the custody agreement,
the mother does not work, and has since remarried to a men who supposely makes alot of money

my question can divorce decrees be overturn or modify like custody agreement?

Yes, anything regarding child custody or child support can be modified.

hi there
i found the exact wording regarding support in the divorce decree.

here it is
in the paragraphs they talk about sharing the costs of education and the like
and then the next paragraph states this
it is agreed that the foregoing provisions regarding the son's support are fair, equitable, and good faith agreement for child support based upon the needs of the child and lifestyle , earning capacity, economic status and future employment prospect of both parties regardless of any current or future cohabitation or marriage by either party with or to any third party so long as the aforesaid agreement is kept, these provisions are meant to be in lieu of any child support action by one party against the other at any time

this is confusing me,
when the son lived with us we paid for his trumpet, clothes, school supplies and never bother the mother for half of this
when the son went to summer camps, the father again paid for half of it
when father was deployed and such and mother had him father paid half for his hockey and hockey equipment.
now the mother has changed the custody agreement to her, and we have not seen the son since july, she wants to modify this as well
the father continues to have son on his medical issurance coverage and dental..

the mother does not work, i understand the accessing of imcome for parties who do and do not work
the only thing that has changed agreeding is that she has him, there is no substantial increase or decrease in our income, perhaps its the other way around,

Your husband has broken that part of the agreement by getting terminated for cause from his military and civilian employment on sexually related charges. Did you forget about that?

first and foremost
no charges have been made about the past situation
so that is a dead deal
he did not lose custody of his son because of that,
he lost custody of his because he employment changed not because of his firing and the like
soo stop with the past ****
good faith, i have the checks written to the mother for half of the camp and the trumpet
so give the past a break
some people in this forum are soo quick to judge people
give a rest
i going to resign from this formun
good bye

oh bye the way, if you think my husband is soo bad
the mother and her boyfriend knew about a rape in a school for special needs and did not nothing about it
