Just found out my husband has married again, but I was never served any divorce papers. I visited the state where he lives (IN) and no papers filed there dating back to 1990. I'm just wondering if he ever filed them. We were married in California. I'm checking those records too. I really don't care that he's married again, but I would like copies of official papers and is abandonment a legal assumption to consider oneself divorced. I'm just looking for financial support for our child. What steps do I need to take to locate this information. Found him through a internet search with a bankruptcy report. Thanks.

If he remarried, he just committed bigamy. SO...you won't have any problems with the divorce.

A person can be given notice in a divorce by publication (running an ad for three consecutive issues) if that person cannot be located through diligent efforts.

It's possible he did notice through publication to divorce you. But there should be a record of the proceeding in the court where he filed the petition and the divorce was granted.

What county does he live in now? How about previously?

And if you had a child together, he owes you for support of that child. It's possible that he lied about the existence of a child in the papers, though.

You have some digging to do here!

Response to Divorce Decree & Child Support

To lawrat ...

I will be in Los Angeles the first week in September. While I'm there I need to know what agency do I go to look up divorce decrees. If he filed for divorce it would be in the Los Angeles County. Is that building on Figueroa or close by. If you can advise, please let me know. Thanks for your previous reply.

Try the superior court for any records on hill and 1st. They sometimes have some interesting records, like divorce decrees. Then check with vital statistics.

Lawrat -

Thanks so much for your help. I will be on Hill & 1st street looking for those goodies. From there I'll ask questions if I need to look elsewhere. Again, thank
you.
