What is the name of your state? arizona

i am filing for divorce i am wondering is there away to allow our house to go into foreclosure to keep my wife from getting her 50%, she doesnt deserve it

That would be a really stupid thing, destroying your credit beyond repair. It happened to me. All bills were paid when I left....three months later the house is G-O-N-E! I should have protected myself from this happening but I didnt have the funds. DONT DO IT for revenge! It is not worth it!

You have to be out of your mind. You want to destroy your own credit and lose out on your 50% of the equity because you think your wife doesn't deserve her 50%???? I can't imagine a stupider thing to do.

Odds are the OP is a troll...I know for a fact that there are some people who have been stupid enough to do that....but its simply GOT to be a rare phenomenon...I just can't believe that any real percentage of people would/could be that stupid.

There is NOTHING that trashes someone's credit more than a house foreclosure. Unless someone has been stupid enough to do one of those 125% refinances (and that is a whole other area of stupidity)....AND is in total bankruptcy....there is NOTHING stupider than letting a house go into foreclosure.

I am not normally this blunt...but that is one thing that just makes me shake my head.

IF your wife has an attorney, or is smart, she will be able to file a motion asking the court to ORDER YOU to PAY the mortgage and NOT let it go into foreclosure. So, the legal answer to your question is: NO, there really isn't any LEGAL way for you to allow foreclosure. Even if you do manage to allow it, a court will almost certainly take a very very dim view of your revengeful action, and who knows, in reality a court can ORDER YOU to PAY your wife the amount her portion would have been worth.

All the way around, it would be a VERY stupid move on your part.

Exactly right. The court WILL do that.

So get your things in ORDER.

Let the house go into foreclosure FIRST, before the divorce or any legal action is taken. Then pick the appropriate time to file for divorce.

Hopefully, you haven't divulged to her your intention to file for divorce.

You post suggests you are not a very smart planner.

Actually that would be helping the guy because if he lets it go into foreclosure before filing the they cant go back and make him pay her half the value. If he waited till after he filed he could still be on the hook for her half.

Either way this post has to qualify for stupidest post of the year.

You're right, I know that IAAL does the funniest or dumbest post of the year thing, I don't know how to nominate this thread, but it sure should be nominated.;)
