I am a mexican citizan with U.S. legal residence. I was married in Mexico City 21 years ago but have residing in the U.S. for almost nine years (7 in Florida, 1 year and seven mos. in California). My husband has worked for the same U.S. company for the past ten years and he bacame a U.S. citizen 3 years ago. Our children are 20 and 18, one in college, one finishing high school. We own property here in California and in Colorado as well as in Mexico. I have seen a divorce lawyer here in CA and he tells me I have the right to divorce here in the U.S. On the other hand, the lawyers in Mexico City say I cannot, that you can only get divorced in the country you got married in. Before incurring in legal costs, I would like to know who is right as I am terribly confused. My husband wants to get divorced in Mexico, I don't. Thank you.

My response:

As long as you meet the California residency requirements, you'll have your divorce finalized after 6 months in California, beginning on the date you have your husband served with the papers. You don't need to go back to Mexico to do this. The Mexican lawyer told you a bunch of crap. Your American lawyer is absolutely correct.
