Phyllis from Tennessee: My divorce was final on Monday April 23, I left court with signed decree in my hand, his was mailed and he has received. He is still threatning to take me to court to get house I was granted for a period of two years away from me if I date anyone or let them in the house. He has told he he will ride by and if he sees any cars here will drag them out by the hair of their head.
What can I do about this? I am 46 years old, legally divorced and living up to my end of the marital disallusionment agreement. Please help
Thanks

My response:

Was your promise of "chastity" in the Settlement Agreement ?

If it wasn't, (or even if it was) then go back to court for an Order of Protection. He has no right to make bodily threats on your person, or a guest. Also, he has no right to trespass. Even if you did make such a dumb promise, he'd have to use other methods to prove your breach of the agreement.

Filing now will force him to stay away from you and your home, and guests, for a lengthy period of time, and for a minimum of 500 feet. So, even if he sees Hugh Hefner's stretch limosine in front of your home, he couldn't do a thing about it. That way, you can make the bed springs creak all you want.

Make sure that you are EXTREMELY EXPLICIT (with all swear words, quotes, and dates) in your Application for the Temporary Restraining Order.

Good luck with Dufus.
