state is california. if a person marries another whose divorce is not final until a week after the marriage is the marriage legal?

I was hoping not to have to run with my thought process but rather the facts, which if I knew, I wouldn't have to be asking.

What I think is, no, the marriage is not legal.

There you go.. you would be right. You need to get this current 'marriage' annulled .

So, if the marriage is not legal, why would it need to be annulled or divorced? (if it's already nothing, why reduce it to nothing?)

Because it has been recorded as a marriage. There are records to say the marriage happened. You need to file to anull so as there are records to show it was nulled.
