My boyfriend and I have lived together for a year now. He has been seperated from his estranged wife for 17 months and has filed for divorce. She will not sign the divorce papers. We want to get married because we have a baby due any day now. They have a daughter and custody arrangements have been done through the courts already and all he needs is her to sign divorce papers. Is there any way he can obtain this divorce legally if she continues to refuse to sign these papers? All property has been divided also. He wants to file a no-fault but she won't agree to it stating he commited adultery, which he didn't until several months after the seperation. Both of them are at fault, but she won't admit to any. Even if he admitted to his fault, she will not sign because she wants sole custody of their daughter which he will not agree to. What can we do? Is there any law stating that he can obtain the divorce regardless if she signs or not? We have heard of a 2 year waiting period from date of seperation, which will be in feb of 2002. This is pennsylvania. Please help.

i am in the same position with my boyfriend (except the baby). his ex refuses to sign the pdivorce papers in fear of missing out on something. we are in the process of waiting the two year period then petitioning the court for the divorce. she can't hold out forever if it helps. i have a friend who's two years is up and she is in the process right now so i will probably learn more as she goes throught it.
