I live in Florida. I was married 2-26-00 and the last time I saw my spouse was 2-29-00. I have never seen him again. The marriage was never consummated. He never gave me any support. He and I agreed on a divorce. I don't know where he is. The last time I heard anything, he was engaged to someone else already and nothing has been done about OUR circumstances. I too live with someone, but we are not engaged yet. He won't ask until my marriage is dissolved. Am I able to obtain an annulment for missing spouse? Or do I have to get a regular divorce? I haven't the slightest idea where he is and it has been almost 14 months since this mockery of a marriage came about. Can someone give me advice on my situation allowable by the state of FL?

My response:

You'll need a standard divorce. You've said nothing in your post that would indicate you are qualified for an annulment. See your attorney.

Thank you for the answer. However, I do have one more that occured to me after posting my question. Could what my spouse have done be considered abandonment? Is there any special steps I need to take? Anything else I need to do? Especially seeing as I have no idea as to his whereabouts?

My response:

Florida is a No Fault divorce State - - so, abandonment doesn't matter. You don't need to know his "whereabouts" in order to get a divorce. Please, see an attorney for details. Most Family Law attorneys will give you a free initial consultation, and will go over all your rights, duties and responsibilities with you. Then, you and your attorney will plan out a map of strategy.
