Divorce or annulment?

What is the name of your state? TX My son was married by proxy while he was in prison. The wife now wants to start a new life. There is a daughter born after he was incarcerated. The daughter is on Medicare and no child support is being paid at this time. We, his parents, have provided all support for the Mother and child until this time. Can this marriage be annulled as they have not physically lived together since the marriage over 1 year ago or should a divorce be filed?

Divorce would be the best choice. Even if it COULD be annuled, it can be a very lengthy and costly task.
