I live in Maryland and am wondering if I have grounds for a "fault" divorce based on my partner's unwillingness to have children (actually adopt, unable to have biologically).

I was looking at the Family Code of MD and according to it, there is no such thing as a "fault" divorce.

So I don't think that your situation would be grounds for divorce.

May I ask why you 2 didn't discuss this topic before getting married? Seems a little irresponsible don't you think. On the other hand, if your partner doesn't want children, do you think forcing him/her would really make him/her love the child?

Anyways, you could always get a divorce on "irreconcilable differences".

Certainly you MAY ask why we didn't discuss before marriage...the answer is...didn't really know that adoption would be an issue. Assumed (and yes...I know the assume quote) that we could have our own biological children.

Ok, I understand completely want you meant. It is sometimes boggles my mind that if they ok the kids part, they don't mean adoption!

Anyways, If you really love this person, you will be able to work it out. If you really want kids, then you will have to make a choice on divorce.
