What is the name of your state (only U.S. law)? Ohio. I want a divorce and my spouse does not want a divorce. Can I still file or do I have to wait a year? If I must be physically separated, can take my personal items from the family and move to another state? Perhaps filing in the other state!

You, yourself, are free to leave and move anywhere ypou wish. Ypou are free to take anything you woned and brought to the marriage. You are free to take your clothes, etc with you. You can establish residency elesewhere if he has not opened a case first, and get divorced. That new locale will have no personbal jurisdictiopn over him, though. So if there is nothing to split, and no kids, just up and move if you want. Joint debts/contracts will continue to be your shared responsibility, regardless of where you choose to live.

You don't have a wait a year. Here are the grounds for divorce in OH:

You can file for divorce at any time you wish on grounds of incompatibility.
