Hello,

My name is Ray and I'm trying to find the process for taking my ex-wife to court to have her wages garished, for failing to make consistent payments to me on a joint account which was opened before the divorce was finalized last August and which was referenced in the divorce settlement. The 'tricky' part, as far as I see it, is:

* I live in California.
* Ex-wife lives in Washington.

Because I could not afford a lawyer to handle the initial divorce, I went to a paralegal (Yeah, I know! I get what I paid for! LOL)
and in the final divorce settlement, there is a reference to 'defendant' ("Ex-Wife") owing $9,000.00 to Petitioner. (Me)

However, there was no stipulation on how soon the 'ex' was given to pay-off this amount, nor any stipulation on what avenues I would have in the event the 'ex' never paid.

I've been told that I could find a lawyer in Washington who would be able to represent me, without me having to actually go to Washington to start the process of possibly having her wages garnished and thus this what I'm trying to confirm.

I'm also wanting to know if it would be possible to have the 'ex' (Defendant) pay for all court/attorney fees?

This really is really more a debt collection question than a family law question, in my opinion. While you could probably pursue it on a contempt basis it may be more effective to handle it as purely a debt.

I believe that there is a forum on this site regarding debt collection....you may want to try your question there.
