Can I obtain a divorce while he is incarcerated. He is well aware of my intention to end our marrage and is consenting completely. We have no assests or children together. Nor do I want any monetary support from him. How should I proceed? Do I have to obtain an attorney or can I do this myself?

My response:

Get a book on Divorce from a major bookstore, like Barns & Noble. Follow the instructions EXACTLY, or you'll wind up starting over.

If you believe you'll have trouble doing this yourself, you could hire a paralegal service (see your Yellow Pages) to do the paperwork and filing for you. Compared to an attorney, this is a cheap method - - but, certainly more expensive than buying a book and doing it yourself.

Well, at least you won't have trouble having him served with the papers. You have a "captive" Respondent.
