when i married 3 and i/2 years ago i was not in debt. 3 days before i got married my husband and i went into a partership with another person. we disolved that parternship and my husband took over with a new dba as sole propriter. the question is: now that i am in debt over my ears, and the company was financed with my money and my credit, who is the legal owner. who is responsible for all the debt should we get a divorce. his service vehicle is in my name which was mine prior to marriage. we traded his vehicle in on a car which is in my current married name. i live in an r.v and need the service vehicle to pull it with. i would think that it would be mine. he could have the car, although the payments are now being made by the insurance company that covers it for disability since i am disabled. we have established some credit in the company name and the material suppliers and state sales tax show him as the responsible party, but i am shown as the responsible party on all others. who is responsible and who is entitled to continue the company. the company checking account is soley in my name and he does not have access to write checks or anything else. i am concerned that he will get all the property that was aquired to do business while i get all the debt and no way to pay for it.
