I live in West Virginia and have only been here for a few months. My question may sound odd but I wanted to know if you have to be out of the home in order to file for a divorce or annulment. Most of the things I've read have said that you have to be living away from each other for a certain period of time.

My response:

Your question is not odd. Every State has it's own particular laws, and West Virginia is no different.

In your case, in order to obtain a divorce in your State, you must be a resident for at least 1 year, and then be separated and living apart for 1 year.
