I want to file for divorce in Arizona and want to know where I get started. I have 2 children and have been married for 6 years.

My response:

Every action for Dissolution of Marriage starts with a Petition for Dissolution filed in the Family Law court. If you can't afford an attorney, and you think you can handle this by yourself, you might try to :

1. Get a "Divorce Packet" from your local courthouse; and,

2. Go to a large bookstore (Barns & Noble, for example) and go to their legal section to review and buy a book on the subject. Read and follow the instructions very carefully. If you make a mistake, it could send you back to "square one".

Or, you could hire a paralegal to do the paperwork for you. A paralegal cannot give you legal advice; but, a paralegal could ensure that the papers are written properly and filed with the court. Yes, it will cost you - - but, it's cheaper than an attorney. If you need legal advice, you're going to have to hire an attorney.

You can find a paralegal service in your Yellow Pages.

Get legal advice

I found it very beneficial to pay for a consultation. It is usually about a $100. I got screwed by just going through a paralegal they ONLY file papers. Get more than one consultation, you can learn alot about your rights that way. There are alot of different routes to take in a divorce. With two kids you need advice. Good Luck! Do what is fair for the kids!
