I am in the process of filing for divorce and would like to know what extra steps I need to take for my husband to give up his rights to the children? I know the court will look at the both of us as sharing custody and this is not the case. I live in California.

My response:

Unless, and until, a child either has another person willing to adopt him / her, or reaches the age of majority, or is otherwise emancipated, a father or mother cannot merely "terminate rights" to that child.

At the very least, until the occurrence of one of these events, your husband will remain obligated to pay child support.

There is no law that will "force" him to visit the children, but he cannot merely give up his obligation to monetarily support them.
