What is the name of your state (only U.S. law)? Massachusetts
i have been married for 13 years my husband walked out 6 months ago. we moved to massachusetts because of his career. Can i make him pay for either all of it or partial of my moving expenses since we were here for his job. plus i only make $8.50 an hour.
You decided to move yourself to Massachusetts, therefore you are responsible for your presence there, unless he tied you up and carried you along in the back of the moving truck, which is a different issue altogether.
Has he returned (with the intent of staying) for any period of time since he's been gone? Massachusetts has desertion as grounds for finding fault in a divorce, under II-III-208.22, but it requires an absence of one full year. http://www.malegislature.gov/Laws/GeneralLaws/PartII/TitleIII/Chapter208
Do you have children together? If so, moving back to a different state might not be a cut and dried issue if Dad objects.
If you feel he should continue to support your accustomed lifestyle, you can request spousal support be included in the divorce settlement, or even possession of the marital home. Division or sale of the marital property may well provide you with the funds to return home if that is your desire. All that is speculation, as there would be other negotiations to consider.
