MY SOON TO BE EX-SPOUSE FAILED TO FILE HIS WRITTEN RESPONSE TO MY DIVORCE COMPLAINT WITH THE COURT BUT INSTEAD MAILED HIS RESPONSE TO MY ATTORNEY.I ASKED MY ATTORNEY TO REQUEST FOR DIVORCE BY DEFAULT DUE TO THIS BUT SHE SAID BECAUSE HE SHOWED UP IN COURT ON THAT DAY HE HAS NOT WAIVED HIS RIGHT AND THEREFORE WE CANNOT REQUEST TO BE GRANTED DIVORCE BY DEFAULT. IS SHE RIGHT?.ALSO DO WITNESSES IN A DIVORCE CASE HAVE TO BE RESIDING IN THE SAME STATE AS THE PERSON FILLING FOR DIVORCE?

You do not say what state you are in. Also, I think they request on this board not to use all caps. In the computer world, its considered yelling and can be difficult to read.
