Texas
My sister in law is leaving her husband {they live in Florida now} and wanting to file for a divorce once she gets back to texas .... I need to find out how long she has to be in this State before she can file and if both parties have to be present?
In the state of Florida both parties have to be present at the time of the hearing they have already divided every thing right down to the vehicles..
She also needs to know how much a divorce costs in this state ......
Thanks

Residency Requirements for Divorce: Texas
Every state has its own divorce laws regarding who is eligible to file for a divorce or dissolution in their state. Since the majority of divorce law varies from state-to-state it is essential that each state protects its jurisdiction and makes sure the appropriate laws are applied to the appropriate divorce cases.
The Residency Requirements Before Filing: One of the spouses must have resided in Texas for 6 months prior to filing and 90 days prior to filing in the county where the divorce is filed. In addition, there is a 60-day waiting period after filing before a divorce will be granted. [Texas Codes Annotated; Family Code, Chapter 6.301].
If you discover that you DO NOT meet at least one of the above residency requirements, you can consider the following 4 options:
1. Do not proceed with a divorce and attempt to save your marriage.
2. Establish residency in this state for the period time set forth above (this does not mean you have to wait to begin the process of getting your documents).
3. Have your spouse do the filing if he or she meets the necessary residency requirements as stated above.
4. Choose another state in which you or your spouse may meet the residency requirements (all state residency laws are unique, so be sure to check the state in which you were married as an option).
