What is the name of your state? Sunny (HaHa) Florida :confused:
DMV question. Currently dealing with DWI charges here in Fl, not the first. I purchased a copy of my Driving record and found a DUI offesnse reported from Virginia. I lived in Virginia many years ago, never charged with DUI but was charged and convicted with refusal. I had a record search done by the VA Beach police VA -DMV etc. No records for me at all. Va Beach did find a record for a person with a different first and middle name that also had my same birthday and social Security number- Obviously not me can you say old time partial identitiy theft ? Any advice on how to have the inaccurate data removed from my FL dmv record? Thanks

You haven't provided anything to suggest the record is inaccurate.
You admit to having been STOPPED for DUI in VA.
You admit to having been charged and convicted of refusal to take (presumably) BAC test.
You admit that 'someone' with your last name, your SSN and your DOB.. has a DUI conviction... apparently in the same town as you!! With those matches, it is far more likely the first and middle names were incorrect, than all the matches were.

Yet, with all that.... your only hope of getting the FL record cleared is to try to get VA to 'correct' their records first. Absent that, there is no way that FL will 'remove' what is provided by VA.

DUI in Virginia Beach also stands for Damning Under Imprecation. That is what %#@&* with the red circle and slanted line over it means on their signs.

:eek: Sorry, I was in a hurry. No,I was never cherged with DUI in VA. Yes I was with a refusal after aking 3 intoxilator test in the field and blowing .03*** each time and declining to take a fourth. Thanks for your response ,it is juat as I thought I will have to see if the court records show the same info and see if I can have them send a notice to FL DMV to remove it. Thanks

And the problem you have is... your refusal to allow the BAC is why your license was suspended.

"If you operate a motor vehicle on Virginia's public roads, you automatically agree to take a chemical test upon request. You are required to take the test. If you refuse, your license will be immediately suspended for seven days and it may be suspended for one year, whether or not you are convicted of driving under the influence. If you are convicted of DUI, the suspension period for refusing the test will be added to the DUI revocation period. You may appeal this suspension in the general district court where you were arrested, or by filing a challenge."

No the problem I have is the arrest record from Nirginia Beah has DXXXX XXX Vxxxxxx on the record and my name KXXXX XXX Vxxxxxx nowhere near the same. Although the social seciryt number and birthday are the same. ??????????? By name it is not my record and they do not have one with my name on it. However somehow this guys info got related to me ? Strange I know.

You didn't take a breath test and you lost your license. Okay, so the record is not perfect but last name and SS# match and you didn't take the test.

Is shows on my Florida DMV report and influences Insurance Rates, employmnet background checks etc. they see innacurate information potentialy costing $XXXXX in inurance rates and issues in changing employment due to background checks. In Fla this is there for life and I guess it has been there since somewhere in the 80"s. I am not rich although I can afford a computer for working my sixty hours a week. I just want it to be correct. :rolleyes:

It has already been shown that due to your conviction, your license WAS suspended.

So, what again was inaccurate about the information in your record???

The innacracy is the DMV record reads convicted of "Driving Under the Influence" not refusal. Generally this also means there is criminal record stating the same. As I am trying to change employment after 13-14 years I do not want innacurate information showing up on a pre-employmentbackground check. I do some hiring myself and know how damaging the difference can be. :confused:

Ask (in writing) the dmv who has this wrong information to give you a certified copy of the conviction. If they cannot, then ask them to change it.

Jeeeze.... this is NOT rocket science!!

If you will contact the VA DMV, you will be told that 'DUI suspension' is due to your failure to test. Based on your post, the record is ACCURATE. There is no 'code' to report 'Suspended due to refusal'. Your refusal to allow them to BAC you is the same thing as DUI suspension. They are the SAME thing!!

Tell ya' what....... since you seem unable to understand this simple concept.... call a VA attorney.

Oh, and that is also wrong. There is NO obligation for the DMV to have ANYTHING certified.
If you ask them.... there response will, at best, be... "Contact the court".
