Do I have a case? (Breach of contract)

Sorry to bother you all. I wanted to find out if I have a case.

Some 6 months ago I was contacted by this person from a web-design team on the net. They said they wanted to hand over a web-design project to me. The web-design project required 1 layout design altered to 2 different colors. Both colors were to be coded in basic html skeletons and then handed off to the customer.

I worked on the design as a member of the web-design team worked on the slicing and coding. The agreement between myself and this coder was that I would request 300$ USD from the customer and would later split that amount by 200$ USD for myself and 100$ USD for my coding partner.

After showing this customer the small/low-grade samples of the web-sites that we made, he expressed great satisfaction. He wanted a price and such. We agreed on 300$ USD. We agreed that only after the money is sent that we will forward the product. I also wanted to secure the purchase and asked him if we have a deal and whether we can expect payment on a certain date. He said yes and provided us with a date. We waited on this date and received nothing. We lost contact with him for a while since all of our deals were unfolding on AIM.

I told my partner that I would handle it and I would find him and such. We found out he was the "CEO" of XMGNetworks.com. After figuring out they have an IRC server, I quickly joined it and entered a channel where I found him. He said he doesn't work like this and that he is sorry but he is tight on money. After months of him being on and off IRC and me not having his contact information we would send e-mails back and forth. It ended up that we found out he lost a brother and a friend to suicide, which happened much later than our deal. In e-mail he requested that we setup a repayment system of 10$USD per month until the 300$ was paid for. I had responded with my PayPal e-mail address, the same one I used to write e-mails to him.

A week passed and the date for the first payment came and went. I asked what his excuse was this time. He said he sent the payment to an address that resembled mine, but had errors like o instead of 0.

I am fed up with these games and I want to get my money. I requested this money months ago and gave him ample time to pay back. I have all of our conversations AIM logs as well as the e-mails we traded of him promising to pay. I got his contact information after doing a who-is on his .com address.

What can be done?

Go to small claims court and tell the judge your story.

I was thinking the same thing. Was just wondering if I have a case... he's in Georgia, I'm in NY btw. I don't know how that works out.
