I have been having problems with my (probably) now former employer. I have been getting mixed responses on this and I want to know once and for all if I have something. I posted a thread somewhere else and they seem to think I have a good case. I posted a thread here and the people here seem to think I have nothing. I'm going to have a go at this one more time.... I apoligize in advance if this is a waste of everyone's time. Here is the quick rundown:
1. I had my falling out with this manager about 8 months ago when he blamed for a loss of merchandise for the first time. "Hundreds of dollars worth of merchandise." He said this in front of my department manager who disagreed and said "no nothing was lost". A union representitive was also in the room, but didn't say anthing. (this is all on tape)
Here I don't think I can do anything. Yes there were third partys...but one didn't agree. The other was just indifferent. I think maybe I can use this to prove the store manager has a history of reckless disregard for the truth/ saying something with malice?
2. Here is the real (possible) case. I put in a request to change my available days to work. I put in two requests actually, to try to prevent any mishaps. The place of business has a nasty habit of "losing" these requests, so I gave in two notes, both within minutes. Well...suprise, surprise... both notes were "lost". Apparently "multiple people saw the note and read the note" and they all know what it said. They are all wrong, however. To make a long story short, this was one of the reasons why I was demoted to the lowest possible position in the store. There were no available hours for the days that I allegedly wrote.
3. The second reason I was demoted was for "not performing my job function". This particular allegation is officially on paper and on record. This is also false. I think I would be able to prove this just with my own gathered evidence. The security tapes (which I'm assuming I'm not going to be able to view without a lawyer) would seal the deal... if the cameras were pointed in the right direction... they should show without a doubt that I did perform my job function.
This is just the quick rundown. I would be sitting here typing for hours if i gave all the specifics. I will give more details if needed.
I have secretly recorded 4-5 key conversations that I have had with the store manager and union people. It is my understanding that this is legal as long as it's my own conversations. If I were eavesdropping, recording conversations that I was not apart of then that would be illegal, correct? I originally recorded the conversations with the intent to show the union that this guy is a bully, not to sue. Weither I have a case or not, I will be sending them to the human resourses department.
This was a part-time job. I know people will wonder why I am fighting over a crappy part-time job. I have worked there for 5 years. It's very flexible. I recieved paid vacations and small benefits. Before this manager came around I loved this place. It hurts to just walk away like this on bad terms.
I have not reported to work since my demotion. Firstly, it'd be humiliating for me to work where they put me. Second, I should not be forced to accept a demotion based on lies.
They owe me vacation time and personal days.
I am not after money. What I really want to do is clear my name and stop this manager from doing this to people.
I was threatened ( BY THE UNION REPRESENTITIVE!!!!!) that if I did take this to human resources that I would be out of a job.
