I have a few quick questions about if I have a case against Social Security?


first off, I have been disabled since 2001 for a mental disability I have had to deal with my whole life unfortunately.
I have two children that have claims with me as dependents but I have a daughter that was kidnapped from me when she was nine months old and she is currently 12 and has been living with me past two years. She was raised in settings I can only describe as Unimaginable. she was very malnourished and also deals with a mental disorder and a free other issues (that i briefly will explain)that I have already started the process of. Also to make a note is that my son has claimed disability for the same issues as myself for approximately four years.

I have been to Social Security year after year for the past 9 years asking and requesting that I be given an address to where my daughter location is currently At.

there was never no court order dening myself information and I have always had custody of my daughter due to the mother signing away her rights she was nine and a half months old(just right before she was kidnapped from me).

Now I do have a question about if I could have a case (or need to speak to an attorney personally)against Social Security Administration due to the past nine and a half years for added mental stress because I was never able to locate my daughter which I found her through social media in Florida till nine and a half years later.

I am currently in the process of getting mental help for my daughter due to the same mental issues that myself my son and my daughter deal with on a daily basis.. while she Orda she was mentally in distress on a daily basis raised to believe that her biological mother what's her aunt and her grandmother wAs Her mother.

If there was no court order, then there was no kidnapping.

Are you even the legal father of the child?



(mental pondering: maybe this is something I don't even want to wade in to...)

Your processes would have been through a criminal and family court if you were determined the legal father, not SSA

You would look at your State's Laws to find out if there were a kidnapping.

They are under absolutely NO legal obligation to tell you anything at all about your child's location. That's not their job, for one thing - and it protects the other parent from an abusive ex if such is indicated.

You give limited back ground of events ,dates, years, convictions, or family court sanctions, orders and so on.

You can not expect a forum to answer your question.

If you wanted to sue SSA then you need to take all the info you have to an attorney , and good luck.

Consult your areas Bar Association referral service for a consult for a fee.

You want to file a claim against the US Government Social Security Administration for mental stress they caused you by following the disclosure laws which denied your right to know where the checks were being sent to someone on your Social Security record, right?

because Social Security deals w/ protected health information, they are required by law to follow HIPAA laws regarding sharing any and all information they had/have.
Now, had there been an active law enforcement investigation regarding kidnapping/abduction, Social Security's records could have been subpoenaed, and any information would/could have been released to the proper authorities...NOT you. Please understand, the employees at Social Security treat everybody's information the same.

I really don't think you have any sort of case, but, you can consult an attorney.

I'm sorry, but you would be incorrect....I do actually work in SSA.

If every request for information is treated as a potential breach of PHI/HIPAA, then there are less breaches of confidentiality.;) (and that is the standard that most SSA office abide by)

Sweetypie, I remember the very first time our unit had to deal with the chaos created by HIPAA.

(Prior to that, clinical trials were so much more ... efficient. In terms of medical records at least)

Now. Care to explain exactly how this impacts the OP?
