Do I have a case?

state: wisconsin
mother of child convinced me that i should pay cash support payments while she was on welfare. when i took her to court to have support determined, the state stuck a $10,000 debt on me saying i did not support my child. mother verbally promised to pay this money if i did not turn her in for welfare fraud. i have my written documentation of paying her and a tape of her saying that she owes the money to me. debt incurred 7 years ago but still paying on it and she is not holding up her end of the agreement. do i have a case at all??

I speak from first hand experience what will happen. You will pay the child support again. In 1993 the federal law concerning distribution of welfare funds to the custodial parent requires that the state collect the child support due and apply it towards the AFDC grant. AFDC grants are loans, not free money, and as far as the state is concerned, you did not pay. Your childs mother could be charged with obtaining fraudulant AFDC grant and at worst will be cut off from any future grants till the amount she collected is repaid. To put it mildly, you got screwed by her more than once.

Our writer was a co-conspirator in the scheme, with knowledge of the facts, and allowed it to take place. There's a theory in the law called "Unclean Hands" . . . and in this case, our writer would definately go to jail for his part in the scheme.
