I recently moved out of my apartment and was imposed a claim for damages on my security deposit. I didn't get along with the apartment manager, therefore I knew she would try to stick it to me on my security deposit. I took extra measure to make sure the apartment was in top shape after I vacated it. I even took pictures just in case she said I left it bad shape. Well she deducted $70 dollars for a repaint and $60 for a full house clean. I wrote a letter objecting to the deduction of my security deposit within the said time Florida law gives you. The same manager evaluated it the second time and said she wasn't in the wrong in the deductions. She sent me a letter stating that there were stains on the wall that needed to be resealed thus a new paint job was applied. She said as for the house clean that the apartment was not cleaned to her companies standards and that it was necessary for the clean.
I did not take pictures of every wall thus it would be hard to prove the stain were not there. Another manager from the same real estate company (different complex) said that all apartments are repainted after a tenant moves out. Do you think I have a case? The lease agreement also states that if either party takes a matter to court the prevailing party would be accessed all lawyer and court fees. If they use a lawyer would I have to pay for him or her? I live in Florida. Thanks for all the help. Any help would greatly be appreciated. I usually would let stuff like this go, but it seems to me that I have been wronged.
