What is the name of your state? South Carolina, the person who I have the problem with is in MI

Hi there, to make a long story short, I want to tell you this involves about 20 direct people and hundreds more after that. I am a small online business owner who had gotten into an unofficial partnership with a few other members and decided to starts a mutual website to be represented, this was because we all wanted to participate in advertising campaigns and faire's etc that we did not have the individual funds, so, we started this whole new website. One person was in charge of the fees etc and she collected all the money. We had planned for months to participate in this mayor event that was national and it was going to be great for our business. At the last minute, the person "in charge" decided to cancel our participation because of some personal reasons to her, then I decided to leave this venture because I started to get a bad feeling about it ... she refused to refund my fees for one, I had to rely in the popular online payment service I had sent her money from, they declined the charge back because of the way the transaction had been made, then I proceeded to report her to the BBB with the truth in my hands ... my money was refunded in I'd say about 2 weeks maybe.

I thought this was the end of that, I figured she naturally would be very angry at my report and would probably start some gossip against me and that would be the end of it ... a few days later I start getting email threats from the other members, threatening with prosecuting me ... I wondered "for what"? turns out she said this HUGE lie about me sending her life threats and calling her in the middle of the night and more things like this ... this was of course completely and absolutely false. I immediately called the police, who, in my small town, for cases like this, is a voicemail, and I never got a call back (too stupid I guess) ... no problem, I thought, this will all end soon. Well, things did end for a while .

I have to add, all these comments and lies are all posted in a blog that I do not have access to since Left, but it's there for the members to see and talk about.

Now, she is stating that she sued me (not true) for an outrageous amount of money, she also said that I filed a report to the "Attorney General" and to top this her lawyer sent me a letter, to who I personally responded and they are threatening to take this to court if I don't back up form my report ... none of this is true, there is no lawyer, there is no letter, I have never had any form of contact with this person whatsoever since I left the group and I want her stopped!

This obviously has me looking like the "loonie" who sends out life threats and is in the middle of a huge legal battle with a known member and it's affecting my business, my sleep, my family, my relationship with other members of the community ... I just don't know where she's going to stop if she is not stopped now.

I have to add, I'm in SC, she is in MI ... or so she said, I don't know anymore because it's all such a huge lie.

What can I do? As "evidence" all I have is a copy of one of the posts she made (no headers) and a lot of people who have witnessed a lot of her behavior and attacks. I don't know how involved they want to get. What Do I NEED to have a good case? Do I have a case?

Well if she wants to sue you, I believe she'll have to go to your state and use your state's legal system. That's a point in your favor as she is most likely bluffing.

If a lawsuit really does occur, the burden of proof will be on her to prove that you made all these calls. If you never made these calls, then obviously the phone company can't produce documents saying you did.

Also, such a lawsuit for her would be incredibly expensive (possibly for you too, to be honest), and even if she won there would be little reward for her.

With all this in mind, I'd say you have absolutely nothing to worry about.

thanks so much, I had seen your reply in another thread something like "If it's the truth, it's not slander" and it hit me (and eased my mind too), she's lying so she can't fabricate all this "evidence" she said she has, so, I'm letting it go, I have a clean conscience and you're right, it would probably be a waste of my money I could be spending on my kid's during the Holidays, so, I'm going on with my life :)

Worse comes to worst, if she does in fact sue me, I will always have the truth in my favor :)
