I was recently pulled over in Massachusetts and issued a citation for speeding. I am planning on contesting this citation for two reasons:

1. I had my cruise control set and was going the speed limit. It infuriates me that I was issued this ticket when I am extra careful to stick to speed limits. I consistently use my cruise control to avoid just such a situation. I feel that, if nothing else, I have to contest this ticket on principal alone.

2. I was in such disbelief that I was being issued a citation for an offense that I didn't commit, that I requested the Massachusetts state trooper show me the radar gun. He replied that, "in the commonwealth of Massachusetts, you don't have that right."

I find it very hard to believe that this last part is true--that I don't have the right to view the only piece of evidence against me.

Can anyone help me with this?

#1. You'll find it a lot easier and cheaper to pay the ticket. You are going to have to prove that your vehicle's cruise control and speedometer are not faulty. And that means a lot of money and an attorney fee.

#2. The trooper is correct. At no time does he have to show you. And you'll have to prove his radar equipment is at fault. I have seen this done. Once a radar gun clocked a tree doing 10 miles an hour, so they can be wrong. But it will mean a lot of time, and going to court, and so on and so forth.

It's up to you.
