I purchased a 2010 Toyota Yaris on December 12, 2009. I have had the transmission on this automobile replaced three times within a 2 year 3 month period. (Four transmissions including the original) The first replacement took place when the car had 16,309 miles, the second replacement was 77, 498 miles, and the third soon after at 80,279 miles. The third does exhibit a pitched noise kind of like a high speed drill. I have taken this back to the dealer where I purchased the car and they have not been able to find the cause of the problem. I spoke to the dealership saying that I was not happy with the quality of the product and was very concerned about this possibly happening in the future. I had an extended warranty at the time that the second transmission failed and was covered for expenses. If I was not covered this job would have cost me $3330.11 out of pocket. The dealership offered me a trade in at some reduced price.

I am writing to find out what rights I have in rectifying this problem. What kind of recourse do I have?

The Lemon Law covers all new passenger, combination passenger/ commercial vehicles and motorcycles purchased or leased in Connecticut:

Which do not conform to the manufacturer's express warranty
Which have substantial defects affecting the use, safety or value of the vehicle AND
If purchased or leased BEFORE October 1, 1998, occur during the first two (2) years from the original owner's delivery date or the first 18,000 miles on the odometer-whichever occurs first.
If purchased or leased AFTER October 1, 1998, occur during the first two (2) years from the original owner's delivery date or the first 24,000 miles on the odometer (whichever period ends first).
I don't think you will qualify due to timing and number of miles at the second repair attempt, but feel free to apply, only costs $50.
