What is the name of your state? I live in Kansas. Recently we remodeled a house that I bought from my mother. It had some termite damage that we replaced and had the house treated and a termite contract put on it. We had central heat and air put in last. Now that we have it on the market and have a very interested buyer, the contractor that put in the central heat and air has told these buyers that the house is full of termite damage and going to fall down soon. This buyer has called me and is concerned about this statement but she did say that this contractor has made other statements that were proven false. We are accommodating her with all the information about the repairs and pictures also to make her feel better.

My question is, do we have any recourse against this contractor? This is not good to say about our house and may hurt the price as well as a sale.

If I do have a recourse, what is it?

What do you call what he did, slander, Libel or something else?

I live in Kansas.

What is the recourse I have against a contractor that has done work for me that is saying bad things about the house I am trying to sell that he worked on? He has killed a sale for us.

The damage to the termites was all replaced and the house was completely sprayed and put under termite contract for life.

See an attorney. Kansas has no licensing requirements for residential Heating and AC contractors but here is a link to the state oversight where you may be able to make a complaint in the mean time, also check on "real estate disclosure laws".

KANSAS LICENSE
Contractors Must register with Dept. of Revenue Robert B. Docking State Bldg. - Topeka KS. 66625 - Phone: (877) 526-7738 Kansas Department of Revenue Website http://www.ksrevenue.org/
