I was recently pulled over in California and given a speeding ticket. The officer claimed i was going 80mph on his radar gun in 65 mph freeway. I was following the flow of traffic with a bunch of other cars around me passing me up. I was just keeping up with the other cars and i was wondering how it was possible for a radar gum to zoom in on just my car in an area where there were around 10 other cars around me traveling the same speed, if not faster. I assume i was pulled over for driving a sporty bright red car amongst plain family sedan-type cars. I would want to fight this ticket, because i think i have a good case, but i need advice from anyone else....Is fighting this worth my time...or should i just take traffic school. If i do take traffic school, will this be erased off my record and insurance?

Thanks in Advance,

My response: how fast were you going?

Hi,

I honestly dont know the speed i was going, i was more focused on maintaning a distance of about 100 feet away from cars in front and behind me...and keeping up with the flow of traffic.

thanks,

My response: then you are guilty of speeding unless you can prove that the police officer was in error, the radar gun was defective and the pace car speedometer was defective.
If you did not know the speed in which you were going then, the officer let you know as documented on your ticket. If you are proven guilty in the court of law, the moving violation will remain on your traffic abstract for reference of your insurance companies until removed pursuant to applicable law.

Do you know if the officer paced your car (i.e. pulled up behind you and drove the same speed you were) after he shot at you with the radar gun? If not, and you really were in a group of cars he can't prove which car was actually doing 80. As for keeping up with the flow of traffic usually they'll leave you alone, but I don't know if they have to. (I was following another car once and they tagged us both.) Check the statutes. Often they're in your public library. If he was being a pain, you could fight it just for the satisfaction of making him show up in court.
