What is the name of your state? New Jersey I was hurt on the job by being hit by a resident in the nursing home I work. I was out of work for 7 days on a doctors not,I called off work on the 8th day because I was still hurting and I was told I had to return becaus my doctors not was only good for 7 days,the doctor I saw was my jobs doctor,I was still hurting but returned the next day.Iam being told I can not collect comp because I wasnt out enough days,comp says you have to be out 7days and I was.This has been going on since January 2003,Iam getting the run around.

I don't know NJ's WC reg's in particular but it sounds as though your State has a 7-day waiting period for indemnity (lost wages) benefits, which is not uncommon. That means indemity payments would begin ON the 8th day. However you were absent without medical authorization on that day, so I expect they wouldn't pay a benefit to you unless you subsequently obtained it.

Regardless of whether you were off work or not, the WC carrier is responsible for your medical bills.
