Michigan- I am a victim in an eavesdropping case. It hasn't gone to pretrial yet so I don't even know if there with be a regular trial. If there is a regular trial I do not want to testify. It will ruin my life more than this whole situation already has. Can't i plead the fifth? Don't I have any right to not testify?

My response:

I'll assist you, but I need you to tell me what it means to "take the 5th".

Also, tell me what "the 5th" is, who is eligible for its protection, and what is the significance of taking "the 5th".

Just give me your off-the-cuff impressions.

Then, we'll go on from there.

i mean can i just refuse to testify, or will that get me arrested? Is it the prosecuting attorney that chooses to subpoena me to testify? It would be so detrimental to mylife to have to testify. it seems like the victims in a case would have some rights but so far i have not seen that.
