Do I have right to the house?

Ok here is my dilema.. In July I purchased a house w/ my now ex-fiance, we were both originally going to be on the mortgage and deed, we had a signed sales contract with both of our names on it, he had much better credit than me so for the better interest rate we took my name off we both put basically equal amounts og money down and his parents gave us a very nice cash gift, we have since split up, he got abusive with my 5 year old, he has moved out. I want to buy him out he says NO WAY, he offered me $$ to leave but I have 2 children in the local schools and they have made this thier home. I do not want to leave. I love this house. Before closing he signed the paper acknowledging my name was coming off the contract for the sole purpose of getting a better rate. What can I do to keep the house if anything? Please help!!! :confused:

**A: you need to hire an attorney and sue. There is no guaranty that you will get to keep the house but could make him an offer in settlement.

I think that is exactly what I will do, I have been approved for a mortgage already, I did make him an offer which he counter w/ a ridiculous amount, Now let me ask you, His parents gave us a gift of 30K when we bought the house can he claim all of that as part of his initial investment?

its more like 99/1 lol..... well my offer to his was fair and resonable... I guess I will just have to see what a judge says, would that be in housing court? And I think I should still send him ( certfied mail od course) 1/2 the mortgage payment every month, do you agree , he closed our joint account and kept all the money for himself and that is where the payment used to come from, whether he cashes the checks or not I dont know but at least I am making the effort. or should I send it all?

would all monies put into the joint acct. be considered or or just down payment total?

**A: all monies contributed by each party may be considered contribution from each party and expenses shared in like manner.
