We recently bought a house. The sellers rented a water softner system from a company. The system was still in the house when we took possession of house. Now three months later the company is wanting to come take system out.Do I have to return it? Should it be mine since it was left with house. I live in Indiana. Thank you.
My response:
For just a moment, think about what you're asking. Does it really make sense to you?
Why would it make sense?
It doesn't, and I'll tell you why, okay?
The seller of your home never owned the water softener (WS), that's why. As a non-owner of property, you can't convey to someone else that which doesn't belong to you. A non-owner of property has no rights to the property and cannot, in any way, shape, or form, convey it to you. All because you bought the house, doesn't make you an owner of property that could not be conveyed to you in the first place.
The WS company was never a part of the contract between you and the home seller. The WS company is entitled to it's property, unless you are willing to sign their contract for service. Otherwise, you have a legal obligation to allow them to remove their property. If you don't, it's only going to cost you more money in wasted time and legal costs, with only the same outcome.
