I've tried looking for the answer to my question online, but everything seems to be lacking one key element of my situation .. my daughters biological father voluntarily terminated his rights.
My fiance and I are going to be getting married, and we've been talking for a long time about him adopting my daughter after we are married.
Two years ago my daughters father voluntarily terminated his parental rights. The only stipulations in this were that I maintain a relationship between my daughter and her paternal grandparents, he pays CS, and has health insurance for her. Though he does not have any rights to her, I still let him see her whenever he wants (which is not often, but still important I think because she knows who he is, and loves him).
I'm looking to know if we begin the adoption process, am I going to need his permission since he's given up his rights to her ? I'm aware that I will probably have to give him notice, etc... but is there something that he's going to have to sign stating that he's okay with it? I know under normal circumstances people will want to adopt a child, AND want to have the bio-fathers rights terminated (from what I've found on the web looking for answers).
Her father is leaving the military in the next few months, and has informed me that he will be moving to Ohio afterwards, so I'm even more motivated to seek out the information I need because I think this will be best for my daughter. She's started to 'detatch' from her bio-father in the past few months since she rarely sees him (example : she draws pics of our family in school, and her bio is never in the pics, only my fiance), so I think this is a good time to get started on the process.
