Do I Need Probate?

What is the name of your state? Texas

My wife died last year and owned nothing in her name alone. We are both on the deed to our house which is worth less than $100,00 with about $10,000 remaining on the mortgage which I continue paying on. Our wills leave all assets and property to each other. Can I change the names on the deed to just my name without going through probate. If yes, how do I do that.

My adult daughter lives with me. Would it be better to have her name and mine on the new deed as I plan to leave her the house when I pass away?

have you deed says joint ownership with the right of survivorship you own the house outright upon her death with no need to probate. Consult a local probate attorney and take your deed.

You may also want to consider a Living Revocable Trust and putting your house in the trust for your daughter. Should she be sued and co-owns the house, the house could/will be at risk. See an Estate Attorney to discuss all your options.
