i live in tennessee. my lawyer is advising me that, in order to prove fraud, i need to be able to prove a pattern of fraud against others. is this true? i don't buy it.

My response:

If you are trying to set up allegations against the defendant or defendants under the "RACKETEER INFLUENCED AND CORRUPT ORGANIZATIONS ACT" (RICO), then yes, your attorney is correct.

However, because you never mentioned the gravamen of your claims and / or cause of action, I am only guessing this is what your attorney is talking about.

Thank-you for replying so quickly. I can prove fraud against
myself. In fact, forgery was one of the tools used. The defendants are threatening to file for bankruptcy, so our lawyer wants to go for fraud, as opposed to breach of contract, because a judgment in a fraud case can't be discharged. Since we have clear and convincing evidence of fraud committed against ourselves, (my spouse and myself), is it necessary to bring evidence regarding other cases in? It is a costly endeavor, and we've already been in litigation for 5 years. Can't we win a judgment if we convince our judge that fraud was committed against only us?

You have given me very little, if any, facts concerning your situation other than the possibility that someone may have committed fraud against you; i.e., I have no idea what your case is about. Further, without knowing your case in detail, and with all the nuances about it, it would be nearly impossible to help you any more than your own attorney has helped you. Therefore, without detailed facts, I cannot give you any more specific suggestions - - other than to say, follow your attorney's advice and directions. Your attorney knows the details and nuances of your facts, and the law relating to those facts.
